myFreedom Terms & Conditions

Membership
1. myFreedom is available at all Freedom stores and online in Australia only.
2. Membership and benefits of myFreedom are for the individual Member aged 18 years or older with a unique email address only. Corporations, partnerships, trusts and other entities are not eligible to participate in myFreedom. Trade Customers cannot be a Member of myFreedom.
3. Employees of Freedom, its related bodies corporates or associated entities cannot be a Member of myFreedom.
4. An individual is deemed to be a Member when they sign up in-store or online and/or identify themselves as a Member during a transaction or join myFreedom prior to delivery of all items in a transaction.
5. When joining in-store, a sales consultant will record the individual’s full name and email address as a minimum at the point of sale. Other details may be optionally recorded. An individual may update their Member Profile at any time by visiting a Freedom store or the Website. It is the Member’s responsibility to update their Member Profile including their email, surname, phone and postal address. If a Member has not provided or updated Freedom with correct details, Freedom may not be able to contact the Member about their membership, Benefits, or entry to competitions.
6. Members may only have one myFreedom membership at any time.
7. Members may not transfer their myFreedom membership or Benefits to another person.
8. The myFreedom program in Australia is separate to, and a different program from, the myFreedom program in New Zealand. As such myFreedom Benefits cannot be transferred between the two programs.
9. A Member may end their membership at any time by contacting Freedom’s Customer Service team at freedom-au.zendesk.com/hc/en-us/requests/new.
10. If a membership is cancelled, all Benefits (including for the avoidance of doubt myFreedom Reward Vouchers) will be forfeited, and all outstanding and future Benefits will no longer be valid.
MyFreedom Benefits
11. To be eligible for myFreedom Member Benefits you must identify yourself as a myFreedom Member before purchase, by quoting your mobile phone number, email or myFreedom Member number and/or name in-store with identification.
12. myFreedom Members are entitled to the everyday Benefit of a $50 myFreedom Reward Voucher for every $1,500 Qualifying Spend at Freedom, within a rolling 12-month period from the date of the first Completed Transaction within that period. For example, if today’s date is 1 April 2023 and a member receives goods worth $100 and has previously spent $100 for goods received on 2 April 2022, and $1300 on 1 December 2022, they would qualify for a $50 myFreedom Reward Voucher. However, if today is 3 April 2023 then they would no longer qualify for the $50 myFreedom Reward Voucher.
13. Freedom may also provide other Benefits to Members, which may differ from Member to Member, in its sole discretion. For example, Freedom may update a Member account with a Reward Voucher as a result of a purchasing behaviour, incentive and/or promotional activities.
14. Examples of Benefits that Freedom may provide to its Members generally, in its sole discretion, from time to time include extended product return periods, and free shipping on homewares.
15. myFreedom Reward Voucher/s shall be loaded onto a Member’s myFreedom account and can be redeemed in-store and also online at the Website.
16. myFreedom Reward Voucher/s can be used in whole or part against future purchases at Freedom, in-store and online, but no change can be given.
17. myFreedom Reward Voucher/s is only valid for a period of three (3) months from the date of issue and no unused balance will be refunded or credited after expiry.
18. Where a Valid Purchase is made in-store or online Qualifying Spend will be calculated approximately 48 hours after the date of the Completed Transaction. Any applicable myFreedom Reward Voucher will be loaded onto the myFreedom account within approximately 48 hours of the Completed Transaction. For example, if a Member buys cushions and takes them home on the day of purchase and orders a sofa in the same transaction the Member will receive the Reward Voucher approximately 48 hours after the final item on the transaction has been delivered and the transaction is finalised in Freedom’s system.
19. Freedom reserves the right to introduce a new Benefit, or to withdraw, cancel or vary a Benefit without notice and at any time for any reason whatsoever in its absolute discretion including without limitation a Reward Voucher awarded in error or a Reward Voucher earned fraudulently.
20. Reward Vouchers cannot be sold, transferred, or assigned and are not redeemable for cash or gift cards.
21. If an order is cancelled, Freedom may adjust or reverse Reward Vouchers that were previously awarded to a Member in that transaction.
22. Members can view their available myFreedom Reward Voucher at any time by visiting a Freedom store or via live chat on the Website, or by going on to the Website and reviewing their account balance
Redemption of Reward Vouchers
23. myFreedom Reward Voucher cannot be redeemed at Freedom Kitchens or used to purchase Freedom gift cards.
24. myFreedom Reward Voucher can only be redeemed in Freedom stores in Australia and online at the Website.
25. When redeeming a Reward Voucher, the Reward Voucher will be applied as a tender on the order, reducing the balance payable.
26. Reward Vouchers can be redeemed in conjunction with interest free offers.
27. All Reward Vouchers have an expiry date which shall be set out when a Reward Voucher is issued, at which point the Reward Voucher will no longer be available for redemption.
28. Only Reward Vouchers from one myFreedom membership can be redeemed per transaction.
29. Freedom will not be held responsible or liable if Reward Vouchers are not able to be redeemed for whatever reason, but specifically in the case of a Technical Issue including without limitation the failure of software or hardware or an EFTPOS malfunction.
30. A Reward Voucher can only be redeemed once.
31. Subject to the other provisions of these Member Terms and Conditions, multiple Reward Vouchers held by the one Member can be redeemed in the same transaction. For example, if a Member has four $50 myFreedom Reward Vouchers, these can all be used at the same time.
32. Freedom reserves the right in its absolute discretion to exclude certain items and promotions from being redeemed by using Reward Vouchers.
33. Returns: If a customer wishes to return a purchase for reasons other than that the goods are faulty or misdescribed:
a. any Reward Voucher redeemed or utilised during the original purchase that is being refunded will be forfeited;
b. any Reward Voucher redeemed or utilised during the original purchase can be honoured for an exchange if the exchange takes place on the same day as the return, otherwise it will be forfeited;
c. any Reward Voucher that may otherwise have been obtained will be kept but the Member will have the value of the return transaction deducted from their myFreedom Spend. This may result in the Member having a negative myFreedom Spend
Privacy
34. Any personal information you supply to Freedom will only be used in accordance with our Privacy Policy and the Privacy Act 1988. For a detailed view of our Privacy Policy, go to www.freedom.com.au/privacy.
35. Freedom may collect personal information from Members for the purpose of facilitating myFreedom, which may include the sharing of a Member’s personal information with the partners associated with myFreedom.
36. As a myFreedom member you consent to Freedom and its partners associated with myFreedom contacting you to provide marketing material concerning Benefits, special offers, product information and other information relating to Freedom and the partners. You can opt out of receiving marketing material at any time.
37. Freedom will communicate to all Members (including those opted out from marketing materials) by email to send you reminders concerning your myFreedom membership, for example: credit issuance, credit expiry reminder notifications and any other service or program related information.
GENERAL
38. These Member Terms and Conditions detail the operation of myFreedom, and any promotional activity and Member transactions that arise as a result of myFreedom.
39. myFreedom is available at all Freedom stores in Australia and online at www.freedom.com.au.
40. Individuals who join myFreedom agree to be bound by these Member Terms and Conditions.
41. The Member Terms and Conditions may be modified at any time without prior notification by Freedom in its absolute discretion.
42. Freedom will not accept any liability for any Member Email or Member SMS that is misdirected, lost or not received other than where that occurs as a result of our error or negligence.
43. Freedom may, at any time and in its absolute discretion, require a Member to provide to Freedom proof of identification (in a form requested by Freedom) for Freedom to verify the authenticity of a Member’s membership and compliance with the Member Terms and Conditions. Failure to provide proof of identification may result in termination of a Member’s involvement in myFreedom.
44. These Member Terms and Conditions are to be read in conjunction with any additional conditions associated with Benefits, the Website terms and conditions and other relevant Freedom policies and/or terms and conditions.
45. Any failure or delay by Freedom in exercising its rights under these terms does not constitute a waiver of those rights. Any waiver by Freedom must be in writing and signed by an authorised officer of Freedom.
46. Nothing in these Member Terms and Conditions is intended to contravene any applicable law. To the extent that any provisions in these Member Terms and Conditions is invalid or unenforceable, it is to be read down so as to be valid and enforceable, and otherwise must be severed to the extent of any invalidity or unenforceability, without affecting the remaining provisions of these Member Terms and Conditions.
47. Freedom will not be liable for any loss or damage suffered by Members resulting from any termination of, or changes to, the myFreedom program, except for any liability which cannot be excluded by law.
48. Freedom may amend the myFreedom Benefits available or these Member Terms and Conditions from time to time. Freedom shall use all reasonable efforts to communicate any changes on the Freedom Website.
49. By joining myFreedom you agree to these Member Terms and Conditions and any variation. You also agree to provide Freedom with any changes to your contact details.
50. Freedom reserves the right to cancel, terminate, modify or suspend myFreedom or any aspect of it at its election, at any time and without notice.
51. Notwithstanding any other provision, myFreedom membership is at Freedom’s absolute discretion and we reserve the right to cancel a myFreedom membership at any time and cease communications without notice. For example, where a Member has been engaged in fraudulent or malicious behaviour.
Definitions
“Benefits” means myFreedom Reward Voucher/s, or other benefits given to Members as a result of purchasing behaviours, incentives and/or promotions.
“Completed Transaction” means all products and services on a transaction have been delivered to the member, or taken from store by the member, and the transaction is finalised in Freedom’s system.
“Freedom” means Freedom Furniture Australia Pty Limited ABN 55 051 493 764, its related entities and its authorised representatives.
“Member” means an individual(s) who signs up to the myFreedom loyalty program.
“Member Emails” means emails that are sent from Freedom to a Member including emails about their myFreedom membership, special offers, discounts, competitions and events.
“Member Profile” means the personal details of the Member.
“Member SMS” means SMS that are sent from Freedom to a Member including SMS
about their myFreedom membership, special offers, discounts, competitions and events.
“Member Terms and Conditions” means these terms and conditions as amended
from time to time.
“myFreedom” means the rewards program operated by Freedom in Australia providing Members with access toBenefits in accordance with these Member Terms and Conditions.
“myFreedom Reward Voucher” refers to a Reward Voucher issued to the myFreedom Member account which can be redeemed at Freedom stores in Australia only and online at the Website.
“Qualifying Spend” means a Member’s net cumulative spend (ie after all discounts, returns etc. have been applied) on Valid Purchases that are Completed Transactions whilst they are a myFreedom Member.
“Technical Issues” means the technical malfunction of any telephone network, connection or lines, computer on-line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the internet or on any website or intranet site.
“Trade Customer” means a customer who receives a discount based on the volume
they purchase.
“Valid Purchases” means all purchases except gift cards, purchases at Freedom Kitchens, and custom made purchases and blinds. Third party services are excluded, for example installation services and delivery services arranged by the Member directly. Any purchases that are returned for a refund will not constitute Valid Purchases, nor will the replacement transaction when there is an exchange.
“Website” refers to the Freedom website www.freedom.com.au where details of
myFreedom (including the most up to date Terms and Conditions) can be found and
where Members can monitor their Membership and Member Profile

TERMS & CONDITIONS
1. Free delivery applies to orders made online at www.freedom.com.au where the total order value is equal to or greater than $99, excluding any delivery charges, and is purchased by a myFreedom Member on a valid membership.
2. Not all suburbs and postcodes are eligible for the free delivery offer. View the eligible suburbs and postcodes for free delivery at www.freedom.com.au.
3. The following online homewares categories are included in this promotion – Outdoor Décor, Organisation, Kids Décor, Tableware, Napery, Glassware, Kitchen Storage, Servingware, Rugs, Cushions, Home Accessories, Home Fragrance & Candles, Curtain Accessories, Artificial Foilage, Wall Décor and Mirrors, Lights, Globes & Accessories, Bedding (comprising Quilt Covers, Quilts, Coverlets, Pillows, Sheets & Pillowcases, Mattress Protectors & Toppers) and Bathroom (comprising Bath Accessories, Bath Mats, Bath Towels and Bath Storage).

5. Freedom may withdraw, cancel or vary a myFreedom Member benefit at any time.
6. Full payment required at time of purchase.
7. Free delivery will be visible on the product page for eligible suburbs and postcodes and applied at checkout.
8. Purchased items must be delivered to the same address at the same time.
9. Not available in conjunction with any clearance offer.
10. Offer is available for normal retail quantities only, subject to availability and while stocks last.
11. Offer not available in-store or at Freedom Kitchens.

TERMS & CONDITIONS
For homewares products purchased by a myFreedom Member on a valid membership and:
• purchased online; or
• purchased in-store and collected and paid for at the time of purchase; however
• excluding products listed below as ‘excluded products’;
in addition to the remedies available under the Freedom Warranty and applicable statute (including the Australia Consumer Law), if you change your mind you may return the product within 60 days of the date of (a) purchase, for instore purchases, or (b) delivery, for online purchases for a refund or exchange provided that the product is:
• returned in its original condition;
• in its original unopened and sealed packaging; and
• accompanied by proof of purchase (the sales receipt or another acceptable form of proof of purchase).
Excluded products are:
• upholstered and furniture products;
• clearance and sale products;
• products sold as seconds, floorstock, repaired products, or products that have a defect where this
has been drawn to the customer’s attention before the purchase of the product; and
• made to order products – products which are made to individual customer specifications, including custom made furniture products, or custom fabric products, which have to be ordered specifically for a customer.

Items posted to Freedom are at the customer’s cost and risk, and Freedom will not refund customers for any products that it does not receive, or that it receives which are broken or damaged. Please make sure you appropriately pack any items before posting these to Freedom.
Except as set out above, Freedom will not provide a refund or exchange, or cancel a product which has been ordered if you simply change your mind, unless Freedom chooses to do so in our discretion.
If Freedom does choose to provide a refund or exchange (or cancel an order) simply due to change of mind, we may ask you to pay a reasonable cancellation charge to us (for example, to cover reasonable storage fees and any mark down on products). We will inform you in advance of the amount of that charge, and you may choose whether or not to proceed with the refund, exchange or cancellation. If you do proceed:
• we will reduce any refund payable to you in the amount of the cancellation charge; or
• if the cancellation charge is more than what you have already paid, we will issue you with an invoice for that amount.
Australian Consumer Law: If you are a consumer under the Australian Consumer Law, you have certain rights, including under the consumer guarantees. Nothing in this policy limits, excludes or modifies any rights you have that cannot lawfully be limited, excluded or modified.

Freedom Warranty
Freedom Warranty
Freedom Furniture Australia Pty Limited ACN 051 493 764 (“Freedom” or “we” or “us” or “our”) provides this
warranty for its products that have been purchased in Australia (“Warranty”). This Warranty is subject to
the Australian Competition and Consumer Act 2010 (“Australian Consumer Law”). The benefits provided
in this Warranty are in addition to other rights and remedies of a consumer under the Australian Consumer
Law, and any other laws in relation to the products to which this Warranty relates. The Warranty period
commences from the date of sale.
The period of the Warranty will be:
(a) 10 years for upholstery frames (including sofas, daybeds, chaise, armchairs and recliners, and
excluding occasional chairs, dining chairs and bar stools);
(b) 2 years for furniture (including upholstery furniture coverings, foam, finishing (stitching, glue, nails,
tacks) and recliner mechanisms), pendant lights and any other product which Freedom identifies
in writing as attaching this Warranty; and
(c) 1 year for all other products.
This Warranty covers the replacement or repair of any product that has a manufacturing or material defect
that is not the result of normal wear and tear, or a natural characteristic of the material used. This Warranty is
not transferable and does not cover products used for commercial purposes.
myFreedom members: The period of the Warranty for upholstery frames, as mentioned at (a) above, for
members of the Freedom loyalty program, myFreedom, will be 12 years.
Exclusions: Subject to the Australian Consumer Law, this Warranty does not apply to any products sold as
seconds, floorstock, repaired products, or products that have a defect where this has been drawn to the
customer’s attention before the purchase of the product. In addition, this Warranty will not apply if:
(a) Repairs to a product are made or attempted by a service provider other than one approved
by Freedom.
(b) The product has not been used or maintained in accordance with the manufacturer’s instructions
as provided with the product.
(c) The customer uses the product in an abnormal manner for example if the product is abused,
misused, dropped, crushed, impacted with any hard surface, exposed to extreme heat (including
fire) or cold, not maintained properly or used after partial failure.
(d) The product has been modified, incorrectly adjusted or operated, subjected to incorrect electrical
supply or inconsistent electrical supply or used with inappropriate accessories.
(e) The product is tampered with in any way.
(f) The product’s serial number, as applied by the manufacturer, has been altered or removed
from the product.
Mattress Warranty: Freedom will pass on any warranty on a mattress provided to it by a mattress
manufacturer to you. The warranty period is as specified by the manufacturer.
Consumer guarantees: Our goods come with guarantees that cannot be excluded under the Australian
Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for
any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or
replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
How to make a claim
To claim under this Warranty, you must:

You will be requested to either return the product for inspection/repair, or we will arrange for the product
to be inspected at your home. Freedom reserves the right to charge an upfront call out fee prior to
inspection of the product, in which case such a fee will be refunded should Freedom determine you
have a valid claim.
If you are requested to return the product to Freedom for inspection/repair, you will need to arrange and
pay for the transportation of the product to the store or other address advised by Freedom. If the product
cannot be returned easily because of its size or height, Freedom will arrange and pay for the transportation
of the product. If Freedom determines there is a valid claim, it will reimburse you for any reasonable
transportation costs paid by you. If Freedom determines you do not have a valid claim, you must reimburse
Freedom for any transportation costs that Freedom has paid and any return transportation costs.
Freedom will assess the product to determine the nature of the issue, whether you are entitled to a remedy,
and in the case of a minor failure, the remedy that will be made available to you. Sometimes we may have
to forward the product to the manufacturer or repair agent and liaise with them. Before a claim will be
processed, we require proof of purchase from you (the sales docket receipt or another acceptable form
of proof of purchase).
